INTRODUCTION
The sitewww.schott-store.com(hereinafter referred to as the Site), is an electronic commerce site, accessible via the Internet network, open to any user of said network. It is published by the company Groupe JAJ.
The Site allows the JAJ group (hereinafter JAJ) to offer for sale clothing, accessories, decorative objects, cosmetics, leather goods, mainly from the protected brand SCHOTT (hereinafter the Products), to Internet users browsing the Site (hereinafter referred to as Users). For the application of these terms, it is agreed that the User and JAJ will be collectively referred to as Parties, and individually referred to as “Party”, and that the User having validated an order will then be referred to as Buyer. The rights and obligations of the User necessarily apply to the Buyer.
It is specified that the Products are intended for the personal use of the User, without any direct connection with the latter's professional activity. As such, the User's attention is drawn to the fact that the same User can only order a maximum of five (5) Products of the same reference. In the event of an order greater than the aforementioned number, the order cannot be accepted.
Any order for a Product offered on the Site requires consultation and express acceptance of these general conditions of sale, manifested by checking the box “Check this box to confirm that you have read and accepted the T&Cs”.
In accordance with the provisions of articles 1316 to 1316-4 of the Civil Code, supplemented by Decree Number 2001-272 of March 30, 2001, relating to electronic signature, it is recalled that checking the box "Check this box to confirm that you have read and accepted the CVG", after reading these general conditions of sale, as well as the validation of the order form as specified in article 3.3 below, constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature and constitutes proof of the entirety of the order and the payability of the sums due in execution of said order.
It is specified that the User may save or print these general conditions of sale, provided however not to modify them.
ARTICLE 1 PURPOSE
The purpose of these general conditions of sale is to define the rights and obligations of the Parties arising from the online sale of the Products offered on the Site.www.schott-store.com
They regulate the various steps necessary for placing the order and ensure the monitoring of this order between the Parties. They apply between the Parties, to the exclusion of any other document.
ARTICLE 2 PRODUCTS, PRICE, INTELLECTUAL PROPERTY
2.1 PRODUCTS
The Products offered for sale are those which appear on the Site, on the day the User consults the Site, and within the limits of available stocks. In the event of unavailability of one of the Products, the Buyer will be informed as quickly as possible.
According to article 1369-4 paragraphs 1 and 2 of the civil code, “without prejudice to the conditions of validity mentioned in the offer, its author remains bound and committed by it as long as it is accessible electronically by its own doing”. Thus, in the absence of any validity conditions indicated in the offer, the offer is valid as long as it is accessible electronically by its author. It is therefore advisable to indicate as quickly as possible on the website the unavailability of a product.
2.2 PRICE
The prices of the Products are indicated in Euros and are valid for all territories. They take into account the amount of French VAT, applicable on the day of the order.
Any order placed on the Site and delivered outside France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These possible customs duties and taxes are the sole responsibility of the Buyer and are their sole responsibility. JAJ is therefore under no obligation to check and/or inform the Buyer of applicable customs duties and taxes.
The prices indicated on the Site are guaranteed on the day of the order and while stocks last.
These prices do not take into account shipping costs which will be invoiced in addition, and which will be specified to the User upon final validation of their order.
JAJ reserves the right, which the User accepts, to modify its prices at any time. However, the Products will be invoiced on the basis of the prices in effect at the time the order is registered, subject however to the availability of said Products.
2.3. INTELLECTUAL PROPERTY
The trademarks and domain names, designs and models, which appear on the Site are the exclusive property of JAJ. Any reproduction or use of these brands, domain names or designs, in any form whatsoever, is strictly prohibited.
ARTICLE 3 REGISTRATION AND VALIDATION OF THE ORDER
3.1 NAVIGATION WITHIN THE SITE
The User can read the different Products offered for sale by JAJ on its site. The user can freely browse the different pages of the Site, without being committed to an order.
3.2 REGISTRATION OF AN ORDER
If the User wishes to place an order, he will choose different Products by clicking on the ADD TO BASKET box. At any time, the User may:
- obtain a summary of the Products he has selected,
- continue or modify its selection of Products,
- Complete your selection of Products and order these Products by clicking on ORDER.
It should be noted that the conclusion of the contract can also be done in English.
To order the Products he has chosen after clicking on ORDER, the User must identify himself by entering his email address as well as the password he will have previously chosen when creating his account. To have an account, the User must complete the form made available to him, on which he will include the information necessary for his identification and in particular his name, first name, postal address, his e-mail address and a password of his choice which will be personal and confidential, and which he will need to identify himself later on the Site.
The User is informed and accepts that entering these two identifiers constitutes proof of their identity and demonstrates their consent.
3.3 FINAL VALIDATION OF THE ORDER
After knowing the status of their order, the User must, to access the secure payment site, click on the type of card with which they wish to make their payment, to definitively confirm their order. The User must then transmit their bank card number, depending on the type of card, its expiry date, as well as the visual cryptogram (the last 3 digits on the back of the bank card).
It is specified that by making an immediate payment by bank card, as provided for in Article 6 below, the User will be automatically switched to the electronic payment server of the secure payment platform (hereinafter referred to as "the Bank"). The bank's server is secured by S>S>L (Secure Socket Layer) encryption, so as to protect as effectively as possible all data linked to means of payment, and at no time will the User's banking data pass through JAJ's computer system. JAJ's responsibility is therefore released.
As soon as payment is validated, the order is recorded and becomes irrevocable. The User becomes a Buyer. The purchase order will be recorded in JAJ's computer records, themselves kept on a reliable and durable medium, and will be considered as proof of the contractual relations between the Parties.
After placing their order, the customer will receive an e-mail confirming it.
In accordance with article 5 below, the Buyer has a right of withdrawal and refund, for a period of fourteen (14) working days from the date of receipt of the Products ordered.
ARTICLE 4 DELIVERY
JAJ will make its best efforts to ensure that the order is shipped within an average of two (2) to seven (7) working days, starting from the day following the Buyer's validation of their order.
JAJ declines all responsibility in the event of excessive delivery times due to the postal services or means of transport used.
In the event of loss of the Products ordered or damage(s) suffered by them during their delivery, the Buyer must make a reasoned complaint to JAJ customer service at the following email address: sav@schott-nyc.fr
As far as possible, the Buyer must indicate, on the delivery slip, any anomalies observed (package and/or damaged product). Furthermore, it is specified that ownership of the Products ordered will only be transferred to the Buyer upon receipt of full payment of the invoiced price, including delivery costs.

We offer delivery the next day with Chronopost. If you order before 7 a.m., you will be delivered the following day, either to the Relais Point* of your choice with “Express Relay” delivery, or directly to your home with “Express Home” delivery. If you order after 7 a.m., you will be delivered the day after, excluding weekends.

ARTICLE 5 GUARANTEES
5.1 Legal guarantees of conformity and hidden defects
Customer Information :
The Products benefit automatically and without additional payment and in accordance with legal provisions:
- the legal guarantee of conformity, for products that are apparently defective, damaged or damaged or do not correspond to the order and,
- the legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and making them unfit for use.
In this respect, we recall the provisions of articles L.217-4, L.217-5, L.217-12 and L.217-16 of the Consumer Code, as well as articles 1641 and 1648 paragraph 1 of the Civil Code relating to the existence and use of the aforementioned guarantees:
Legal guarantee of conformity:
Article L.217-4 of the Consumer Code
“The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility. »
Article L 217-5 of the Consumer Code
“The property complies with the contract:
1° If it is suitable for the use usually expected of similar goods and, where applicable:
- If it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;
- If it presents the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted. »
Article L.217-12 of the Consumer Code
“The action resulting from the lack of conformity is prescribed two years from the delivery of the goods”.
Article L.217-16 of the Consumer Code
“When the buyer requests from the seller, during the course of the commercial guarantee which was granted to him during the acquisition or repair of movable property, a repair covered by the guarantee, any period of immobilization, of at least seven days, is added to the duration of the guarantee which remained to run. This period runs from the buyer's request for intervention or the making available for repair of the goods in question, if this making available is subsequent to the request for intervention. »
With regard to the aforementioned elements, the Customer therefore benefits from a period of two years from delivery of the Product to take action against GROUPE JAJ and can choose between repair and replacement of the Product ordered, subject to the cost conditions provided for by article L.217-9 of the Consumer Code.
The Customer may obtain the resolution of the sales contract or its revocation if the defect is major and the time limit for the chosen solution exceeds one month from his request or if no method of bringing the Product into conformity is possible.
The Customer is exempt from providing proof of the existence of the lack of conformity of the Product prior to delivery of the Product and for a period of 24 (twenty-four) months following delivery of the product.
If the Customer wishes to implement the legal guarantee of conformity, he must send a registered letter with acknowledgment of receipt to the following address: GROUPE JAJ 25 rue de Romainville 93100 Montreuil and return the Product ordered, attaching the invoice.
Legal guarantee for hidden defects:
Article 1641 of the Civil Code
“The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it, or would have only given a lower price, if he had known about them. »
Article 1648 paragraph 1 of the civil code
“The action resulting from redhibitory defects must be brought by the purchaser within a period of two years from the discovery of the defect. »
The Customer can therefore decide to implement the guarantee against hidden defects in accordance with article 1641 of the Civil Code; in this case, he can choose between canceling the sale or reducing the sale price in accordance with article 1644 of the Civil Code.
If the Customer wishes to implement the legal guarantee for hidden defects, he must send a registered letter with acknowledgment of receipt to the following address: GROUPE JAJ 25 rue de Romainville 93100 Montreuil and return the Product ordered, attaching the invoice.
Depending on the regime invoked by the Customer and provided that all the legal conditions of these two regimes are met, GROUPE JAJ will reimburse, repair or replace, where applicable, the Products deemed non-compliant or defective.
Reimbursements for Products deemed non-compliant, defective or defective will be made as soon as possible and at the latest within fourteen (14) days following GROUPE JAJ's observation of the lack of conformity or hidden defect. Reimbursement will be made by credit to the Customer's bank account or to their Paypal account used to pay for the order.
GROUPE JAJ cannot be held liable in the following cases:
- non-compliance with the legislation of the country in which the products are delivered,
- in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer and,
- in the event of normal wear and tear of the product, accident or force majeure.
GROUPE JAJ does not grant any specific commercial guarantee relating to the Products.
RETURN TERMS
You have 30 days following receipt of your order to notify us of your return request and return part or all of your order.
In accordance with the general conditions of sale, only unworn, unstained, undamaged, unwashed items with labels, pouch/case/cover intact will be accepted.
Returned items must be in resalable condition.

2 – Select itemwhich does not suit you, andindicate the reason for the returnassociated. If several items are being returned, then select the additional item(s) to return and/or the quantity.
3 – Validate your requestback
Return costs are the responsibility of the customer and vary depending on the country:
- France: €4.95
- Belgium, Germany, Luxembourg and the Netherlands: €7.95
- Spain and Portugal: €8.95
These fees are applied for a return via the carrier Chronopost.
* The return is made under the responsibility of the customer, GROUPE JAJ cannot be held responsible in the event of loss or theft of the package. The Customer is advised to send his return with tracking, and to keep the documents concerning it, in order to follow the progress of the delivery, until notification of receipt by the services of GROUPE JAJ.
Returns are made EXCLUSIVELY by post, in-store returns are not available.
6 - After receipt and processing of your package by our services, and provided that the return complies with the return conditions above, the refund will be made within a maximum period of 14 days after receipt of your package in our warehouse on the payment method used during the purchase (Paypal or credit card)
Depending on the banking processing times of the Customer's bank, the reimbursement may take 5-10 working days to appear in their bank account.
In the event of a return from a country affected by customs duties, the Customer must mention that it is a return of goods on the customs declaration. Failing this, customs duties relating to this return will be the sole responsibility of the Customer.
ARTICLE 6 PAYMENT
Payment will be made, unless the server is unavailable, immediately on the Internet, by payment card issued in France or by payment card issued abroad by the Visa, Eurocard/Mastercard networks via our banking partner Payplug or payment in 2X, 3X or 4X by bank card with our partner ALMA.

In any case, JAJ reserves the right to refuse any order or delivery in the event of exceeding the ceilings indicated above, of an existing dispute with the Buyer, of total or partial non-payment of a previous order from the Buyer, of refusal of authorization for payment by credit card from banking organizations, of non-payment or even of partial payment. JAJ cannot be held liable under any circumstances.
ARTICLE 7 COMPUTING AND FREEDOMS
The provision of personal data collected in the context of distance selling is mandatory, this information being necessary for the processing and delivery of orders, as well as for the preparation of invoices. This information is strictly confidential and will not be transmitted to third parties, with the exception of companies affiliated with JAJ, which the User expressly accepts.
In accordance with law n°78-17 of January 6, 1978 relating to data processing, files and freedoms, the processing of personal information collected on the Site has been declared to the National Commission for Information Technology and Freedoms. ARTICLE 8 MISCELLANEOUS STIPULATIONS
8.1 RESPONSIBILITY
The Sitewww.schott-store.comhas, for all stages of access to the Site, ordering the Products, delivery thereof, or any other subsequent services, only an obligation of means. The Site cannot be held responsible for any inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.
8.2 FORCE MAJEURE
JAJ will not be responsible for the non-performance, total or partial, of its obligations under this contract, if this non-performance is caused by an event constituting force majeure, in particular in the event of disruption or total or partial strike in particular of postal services and means of transport and/or communication, flood, fire, and generally, in the event of an event beyond its control.
The Parties agree that they must consult as soon as possible, in order to jointly determine the terms of execution of the order during the duration of the force majeure event.
8.3 PARTIAL INVALIDITY
If one or more stipulations of these general conditions of sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain their full force and scope.
8.4 SPYWARE AND COOKIES
“When an Internet user visits the Site, JAJ may store information on their terminal. This information takes the form of “cookies” or similar files. Cookies are data containing no personal information sent via its server to the Internet user's hard drive. The role of cookies is in particular to identify the Internet user when they connect to the Site and to facilitate their participation in certain events and activities on the Site.

8.6 ENTIRE CONTRACT
These general conditions of sale and the order summary sent to the Buyer form a contractual whole and constitute the entirety of the contractual relations between the Parties. In the event of a contradiction between these documents, the general conditions of sale will prevail.
8.7 LAW APPLICABLE TO COMPETENT JURISDICTIONS
These general conditions of sale and the contractual relations between the Parties are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action.
